Terms of Service

Welcome to Samachaar.AI ("Platform," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Samachaar.AI regarding your access to and use of our news platform, website, mobile applications, and related services (collectively, the "Services").

By creating an account, accessing, browsing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Services.

• "Account" means the user account created to access premium features and services.
• "Content" means all news articles, videos, images, polls, quizzes, analyses, and other materials available on the Platform.
• "Premium Subscription" means the paid subscription service (₹99/month) providing access to exclusive features.
• "User Content" means any content, including poll votes, quiz responses, comments, or feedback you submit to the Platform.
• "Free Trial" means the 14-day trial period for Premium Subscription with no payment required.

3.1 Age Requirement

You must be at least 18 years of age to create an account and use our Services. By creating an account, you represent and warrant that you are 18 years or older and have the legal capacity to enter into these Terms.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Providing accurate, current, and complete registration information

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate, with or without notice.

4.1 Subscription Plans

Samachaar.AI offers a Premium Subscription with the following terms:

• Price: ₹99 per month (plus applicable taxes)
• Free Trial: 14-day trial period with full access to premium features
• Billing: Automatic monthly renewal unless cancelled before the renewal date
• Payment: Processed securely through Razorpay

4.2 Free Trial Terms

New users are eligible for a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid monthly subscription at ₹99/month. You may cancel anytime during the trial with no charges.

4.3 Automatic Renewal

Your Premium Subscription will automatically renew each month on the anniversary of your subscription date. You will be charged the then-current subscription price. You can cancel auto-renewal at any time through your account settings.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the end of the paid period. No partial refunds will be provided for unused portions of the subscription period.

4.5 Price Changes

We reserve the right to modify subscription prices with 30 days advance notice. Price changes will apply to renewals after the notice period. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

5.1 Payment Processing

All payments are processed through Razorpay, a PCI-DSS compliant payment gateway. We do not store your complete credit/debit card information on our servers. By subscribing, you authorize us to charge your chosen payment method on a recurring basis.

5.2 Payment Failures

If a payment fails, we will attempt to charge your payment method up to 3 times. If payment cannot be processed, your subscription may be suspended or cancelled. You are responsible for updating your payment information to ensure uninterrupted service.

5.3 Taxes

You are responsible for all applicable taxes, including GST and other indirect taxes. The subscription price does not include taxes unless explicitly stated.

5.4 Refund Policy

Please refer to our Refund Policy for detailed information about refunds and cancellations.

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Share your account credentials with others or create multiple accounts
• Use automated tools (bots, scrapers) to access the Platform
• Attempt to reverse engineer, decompile, or hack the Platform
• Upload malware, viruses, or malicious code
• Engage in fraudulent voting on polls or quiz manipulation
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Republish, redistribute, or commercially exploit our Content without permission
• Interfere with or disrupt the Platform's security or functionality
• Use the Platform for any illegal or unauthorized purpose

Violation of these restrictions may result in immediate account termination and legal action.

7.1 Our Content

All Content on the Platform, including but not limited to text, graphics, logos, images, videos, software, and compilation of news, is owned by Samachaar.AI or our licensors and is protected by Indian and international copyright, trademark, and intellectual property laws. The Samachaar.AI name, logo, and all related marks are our trademarks.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and Content for personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

7.3 User Content License

By submitting User Content (poll votes, quiz responses, feedback), you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, analyze, and display your User Content for the purpose of operating and improving the Platform. We may aggregate and anonymize your User Content for analytics and research purposes.

Our Platform may contain links to third-party websites, news sources, or services. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of third-party content or services.

News articles and content are sourced from various publishers and media outlets. We aggregate and present this content for informational purposes. The opinions expressed in third-party articles do not necessarily reflect our views.

9.1 "AS IS" Basis

The Platform and Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content.

9.2 No Guarantee of Availability

We do not guarantee that the Platform will be available at all times, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue any part of the Services at any time without notice.

9.3 Content Accuracy

While we strive to provide accurate and timely news content, we make no representations or warranties regarding the accuracy, completeness, or reliability of any Content on the Platform. You should independently verify information before relying on it.

To the maximum extent permitted by applicable law, in no event shall Samachaar.AI, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Platform
• Any bugs, viruses, trojan horses, or the like transmitted through the Platform by any third party
• Any errors or omissions in any Content or for any loss or damage incurred as a result of your use of any Content

Our total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or ₹1,000, whichever is greater.

You agree to indemnify, defend, and hold harmless Samachaar.AI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your User Content or conduct on the Platform
• Your fraudulent, illegal, or unauthorized use of the Services

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to our data practices as described in the Privacy Policy.

We collect demographic information (age, gender, location, occupation, education, income) to personalize your experience and provide aggregated poll insights. This data is handled in accordance with the Information Technology Act, 2000, and applicable Indian data protection laws.

13.1 Participation

By participating in polls and quizzes, you grant us permission to use your responses for analytics, demographic insights, and content improvement. Poll results may be displayed publicly in aggregated, anonymized form.

13.2 Fair Use

You agree not to manipulate poll results through automated voting, multiple accounts, or fraudulent means. We reserve the right to invalidate suspicious votes and ban accounts engaging in manipulation.

13.3 No Prizes or Rewards

Polls and quizzes are for informational and engagement purposes only. Participation does not entitle you to any prizes, rewards, or compensation unless explicitly stated in a specific promotion.

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India.

14.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at legal@samachaar.info to attempt to resolve the dispute informally. We will make good-faith efforts to resolve disputes within 30 days.

14.4 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator in India, in English language.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email notification to registered users
• Displaying a prominent notice on the Platform

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services and cancel your subscription.

16.1 By You

You may terminate your account at any time through your account settings. Termination does not relieve you of any payment obligations for the current billing period.

16.2 By Us

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, fraudulent activity, abusive behavior, or prolonged inactivity.

16.3 Effect of Termination

Upon termination, your right to access and use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

17.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Samachaar.AI regarding the Services and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or governmental actions.
