On Friday, the Supreme Court of India allowed Jane Kaushik, a 31-year-old transwoman, to apply under the 'transgender' category for teaching positions in Delhi government schools. The court issued a notice to various government bodies, including the Delhi government and the Union government, regarding her broader plea for separate vacancies and a comprehensive recruitment policy for transgender persons in public employment. Kaushik's application faced barriers due to the online registration system, which previously only recognized binary gender categories of 'male' and 'female'. The court's interim order ensures her application will not be rejected based on gender classification. Kaushik's petition also calls for the implementation of the Transgender Persons (Protection of Rights) Act, 2019, which mandates non-discrimination in employment. This case follows a January 2023 decision by the Delhi High Court that allowed her application to be processed without gender specifications. The Supreme Court has previously criticized the poor implementation of protections for transgender individuals and established an advisory committee to formulate an Equal Opportunity Policy.
