The order was issued by Justice Subhash Vidyarthi following a petition from S Vignesh Shishir, a Bharatiya Janata Party (BJP) worker from Karnataka, who claims that Gandhi holds British citizenship. Senior advocate SB Pandey, representing the Union government, confirmed the court's directive, noting that the case may also involve central agencies due to its implications regarding foreign citizenship. The petition had initially been dismissed by a special MP-MLA court in Lucknow on January 28, which stated it lacked jurisdiction over citizenship matters. The case was transferred to the Lucknow bench from Rae Bareli on December 17, 2025, after the complainant's application.
