The Delhi High Court has ruled that candidates from the Economically Weaker Sections (EWS) are not entitled to additional relaxations in the upper age limit and number of attempts for Central government jobs. The Court stated that the existing policy, which provides 10% reservation for EWS candidates, does not violate any constitutional provisions. It highlighted that EWS is a distinct category based on economic disadvantage, unlike Scheduled Caste (SC), Scheduled Tribe (ST), and Other Backward Classes (OBC) categories, which are based on historical and social disadvantages. The Court asserted that economic hardship is not static, and therefore, differential treatment in granting relaxations does not violate the principle of equality under the Constitution. It also noted that decisions regarding relaxations involve various considerations, including administrative feasibility and resource constraints, which are within the Executive's domain. Ultimately, the Court found no merit in the petition and declined to alter the existing policy.
